The Maine Senate on Thursday gave initial approval to legislation that would permit same-sex couples to marry. The Senate voted 21-14 to approve the measure (gaining a vote from the first reading), following an emotional debate. An attempt by conservatives to put the issue before voters was soundly defeated. The measure now moves to the House. [Link]

As the biological mother, Dickson, now remarried and with a husband, legally has all rights to the child, with no challenge to her fitness as a parent. Edvalson, formerly one of two mothers in the household, is now a "legal stranger." Fundamentally, the issue is whether one parent can cut off the other after both have done everything possible under Utah law to secure their relationship to the child. [Link]

The fact that a run of states have legalized gay couples' marriages in recent months -- either by court decision or by legislative action -- with little backlash is only one indication of how public attitudes about this subject appear to be changing. More significant is evidence in polls of a widening divide on the issue by age, suggesting to many Republicans that the potency of trying to use real people as wedge issues is on the decline. It simply does not appear to have the resonance with younger voters that it does with older ones. [Link]

The Empire State Pride Agenda sent the following email alert earlier today:
Two major New York newspapers endorse marriage equality
Today, two important newspapers in upstate New York have editorialized in favor of marriage equality for same-sex couples. The Post-Standard in Syracuse and the Press Republican in Plattsburgh both strongly and eloquently argued the need to immediately pass a bill that would provide access to the 1324 rights and protections that come with a New York State marriage license.
From the Post-Standard:
“Legalizing gay marriage—moreso than the halfway measure of civil union—would strengthen and affirm the long-term commitments same-sex couples make to each other. That doesn't weaken families; it bolsters them.”
From the Press Republican:
“Same-sex marriage is a civil-rights issue, and on that, the government has only one choice: to come down heavily in favor of the civil rights of everyone.”
These papers join The New York Times, the Buffalo News, Albany’s Times Union, El Diario/La Prensa, Hudson Valley’s Journal News, Middletown’s Times Herald-Record, the Ithaca Journal and the Poughkeepsie Journal as major newspapers in New York State that are on record in support of marriage equality.

Love Makes a Family just sent this release upon the Governor's signing of the marriage equality bill to reaffirm the court decision in Connecticut which upheld the freedom to marry for gay couples:
Governor Rell Signs Same-Sex Marriage Codification Bill Into Law;
Bill Passed Legislature with Strong Bipartisan Support
Bill contains reasonable exceptions to ensure religious freedoms
Hartford—Late last night, the Connecticut legislature passed SB 899-- the marriage codification bill-- with overwhelming bipartisan support: 28-7 in the Senate and 100-44 in the House. Senator Andrew McDonald and Representative Michael Lawlor provided extraordinary leadership in ensuring the passage of the bill. Governor Rell promptly signed the bill today.
“This bipartisan vote is a strong affirmation of the Kerrigan decision and the dignity and respect of same-sex couples and their families,” said Anne Stanback, Executive Director of Love Makes a Family. “Today, fairness won out over fear.”
Despite furious lobbying and an expensive ad campaign by anti-gay opponents, the expected amendments to retain insulting, anti-gay language and to allow businesses or individuals to discriminate had little support. The bill does not undermine state anti-discrimination laws, and it does not allow state actors such as Justices of the Peace or individuals such as florists to discriminate.
“The approved bill includes reasonable exceptions to ensure religious freedom for clergy and religious organizations, exceptions that already exist in state law,” said Stanback.
SB 899 conforms state statutes to the Supreme Court’s ruling in the Kerrigan case, provides recognition, by the state of Connecticut, of marriages, civil unions, and domestic partnerships from other states which provide substantially similar benefits to marriage, and clarifies the status of civil unions, merging them with marriages after October, 2010.

Damon, a Democrat who is the bill’s sponsor. “It recognizes the worth and dignity of every man and every woman among us.” (Link)

EDITORIAL: In marriage for gay couples, government has no stake in denying civil rights
The Press Republican
April 23, 2009
The Northeastern New York newspaper editorializes, "People who oppose same-sex marriage generally do so on moral or religious grounds, neither of which can be legislated. The issue of same-sex marriage is so personal that the government would be wisest to stay right out of it. In other words, government shouldn't go around banning things just because they don't match up with some people's moral or religious notions. Assemblywoman Janet Duprey has it right. Same-sex marriage is a civil-rights issue, and on that, the government has only one choice: to come down heavily in favor of the civil rights of everyone." (Link)

For more than 20 years, U.S. Senator Sheldon Whitehouse (RI-D) has served the people of Rhode Island: championing health care reform, standing up for our environment, helping solve fiscal crises, and individual liberties. In response to On the Issues question about support for marriage equality, he responded, "I support the right of states to allow same-sex marriage. It is wrong for the federal government to intervene in what has always been a state issue -- the regulation of marriage. I think it is particularly wrong to amend the Constitution to single out gay people and prevent them from exercising their rights."

He is committed to strengthening public education, protecting our environment, helping military families, and supporting Wisconsin’s farmers and rural communities. He is on the record as stating, "Gay and lesbian couples should be able to marry and have access to the same rights, privileges and benefits that straight couples currently enjoy. Denying people this basic American right is the kind of discrimination that has no place in our laws, especially in a progressive state like Wisconsin. The time has come to end this discrimination and the politics of divisiveness that has become part of this issue." He has also spoken out powerfully against any federal amendments to discriminate against the gay Americans.

Tammy is also a forceful supporter of civil rights and an advocate for those in our society whose voices, too often, are not heard.
On her website she states, "I believe in full marriage equality for gays and lesbians. Our constitutional system - the checks and balances between the three co-equal branches of government - was created to ensure the protection of minority rights, and throughout history many groups of individuals have sought such protections from their government. Today, people who want the protections of marriage laws for their same sex partnerships are petitioning their government."

César was one of the first civil rights leaders to speak out for gays and lesbians, because he understood that you can’t demand equality for your own people while tolerating discrimination against anyone else."As a champion for justice, he would have been glad to know that California finally allows gay and lesbian couples to marry, because that brings us one step closer to his vision for communities where everyone is accepted and respected. For 45 years, I stood with Cèsar for what is right. Today I celebrate his memory as I see so many newly married gay and lesbian couples celebrate their marriages. On Friday, April 3 the Iowa Supreme Court unanimously ruled in favor of marriage equality for gay and lesbian couples. Recognizing marriage for caring, committed gay and lesbian couples will continue a long-standing Iowa tradition of protecting all its citizens and treating each Iowan fairly.
We hope this ad will start a conversation with Iowans about the Supreme Court decision, which isn't just about gay and lesbian Iowans-it's about ALL Iowans. We know that marriage strengthens families and, as Iowans, we support committed couples who want to accept the responsibility that comes with marriage.
We invite you to view our ad and participate in a statewide conversation about marriage. Talk to your family, friends, and neighbors. Discuss what marriage means to you.

Voice for Equality: Keith Ellison
U.S. Representative Keith Ellison (D-MN) has served the fifth congressional district of Minnesota since January 2007. Representative Ellison is a member of the Minnesota Democratic-Farmer-Labor Party (DFL).He is the first African American from Minnesota to serve the US Congress. He is also the first Muslim to serve in the US Congress. Previously, Mr. Ellison served in the Minnesota State House of Representatives (District 58B) from 2003 to 2007.
In February 2009, Rep. Ellison co-sponsored the bill “Uniting American Families Act.” The legislation would allow non-citizen partners of gays and lesbians to gain permanent resident status in the same manner as married couples.
While serving in the Minnesota state legislature he adamantly opposed denying marriage rights to gay and lesbian couples via constitutional amendment (MN House Bill - HF3922): “What marriage, what single heterosexual marriage that exists today will be saved today because of this amendment? I would suggest to you not one. ...In 1954, the United States Supreme Court, maybe a bunch of activist judges in the minds of some people, said that black school children could go to school in the same classrooms as white school children. Was that the act of an activist judge? Let me ask you this though, what would happen if we put it to the vote? What would happen if we put the Equal Protection Clause to the vote? I dare say that it would fail."
Keith Ellison, Minnesota House speech in response to HF3922 proposing an amendment to the MN state constitution to define marriage, (2006). The 2006 bill failed but MN state politicians have since introduced four similar, failed measures and vow to keep trying.

And I think everybody should have the right to share homes and finances with somebody that they care about. You know, on those types of things, I am very supportive. When it comes to marriage, you know, I think that civil rights need to be for all.”
"One of the things that we have to be careful of is that we don't create hate. Because people believe certain things and we can’t make everyone become homogenized. You know. Everybody has a right to believe what they believe, but I do, I do think everybody has a right to have civil rights. That’s what I believe." Voice for Equality: Tyne Daly
Actress Tyne Daly is best known for her portrayal as detective Mary Beth Lacey in the television show Cagney and Lacey, Tyne Daly is a strong feminist who uses the same force in her acting roles as she does when taking on opponents to marriage equality.Last fall Daly appeared with several other notable straight allies (such as Amy Brenneman and Dolores Huerta) in a series of public service announcements entitled "Stop the Hate, Vote No on Prop 8", concerning the notorious Proposition 8 on California's ballot that would rescind marrying rights for gays and lesbians. Besides serving as a strong, can-do role model for women and feminists alike, Daly proves that you do not have to be gay to support marriage equality.
On one of her stops during the "Stop the Hate, Vote No on Prop 8" campaign, Daly recalled her former marriage to her a husband (an African American) and told of her own experiences with marital discrimination, thus bolstering her support for marriage equality: "When I got married," Tyne Daly recalls of her marriage to African-American actor Georg Stanford Brown, "my marriage was illegal in seven states in this country...Government can't dictate hearts and minds. But it can decide law, and when laws [change], other things change."
Freedom to Marry thanks Chaya Himelfarb for nominating Tyne Daly as a Voice for Equality!

Voice for Equality: Nathan Lane
Actor Nathan Lane is best known for his hilarious roles such as the scheming Max Bialystock in The Producers, the ever-so loyal Pseudolus in A Funny Thing Happened on the Way to the Forum, and the cross-dresser Albert in The Birdcage.
Lane's grace and humor have transcended into his personal life as well; when Lane told his mother that he was gay she said to him (quite plainly), "I wish you were dead." To which Lane wryly replied, "I knew you'd understand." After courageously coming out of the closet in the wake of Matthew Shepard's death, Lane has worked relentlessly with Broadway Cares/ Equity Fights Aids, and has been honored by organizations such as the Human Rights Campaign and the Trevor Project.
In an April 2009 interview with The Advocate, Lane said that he and his long-time partner were not considering getting married; however, he proclaimed that "I'll fight for the rights of everyone else, but we're [him and his partner] are perfectly happy the way we are."

U.S. Senator Frank Lautenberg (D-NJ) believes in standing up for people. In April 2008, he received the endorsement of Garden State Equality for standing up for LGBT rights and made his support for marriage equality clear saying, "The government should get out of the business of telling same-sex couples in committed relationships that they can't marry. Anything else is not equality."Over his first three terms in the U.S. Senate, Lautenberg built a solid record of accomplishment on a broad range of issues that touch the lives of New Jerseyans: helping to balance the federal budget, stopping aid to nations that support terrorism, keeping guns out of the hands of convicted domestic abusers, banning smoking on airplanes, getting drunk drivers off our roads, protecting our oceans and environment, and improving our transportation system.
