Many people have questions about what the current court challenges are in California, and this article sums them up stating, "All three of these cases proceed on a similar theory: that the enactment of Proposition 8 was invalid because it is actually a 'revision' of the California Constitution rather than a mere amendment." If the Court decides that it is actually a "revision," then its enactment through the initiative process is unauthorized and it will be stricken from the state constitution by the Court. [Link]
